Judicial Expert Trainer – Academic Unit

ABOUT THE IIJ

Since its inauguration in 2014, the International Institute for Justice and the Rule of Law (IIJ) has trained more than 7000 criminal justice practitioners through its interactive capacity-building workshops – in Malta and abroad – that enhance the competencies of parliamentarians, judges, prosecutors, police, prison and other criminal justice practitioners to address terrorism and related transnational criminal activities within a rule of law framework. The IIJ, one of three institutes with a mission to implement good practices developed by the Global Counterterrorism Forum (GCTF) and other international and regional fora, delivers capacity-building training tailored to the needs of the regions it serves, including North, West and East Africa; the Middle East; and select engagement in the Balkans, and Central, South and Southeast Asia. In 2020, the IIJ launched an Academic Unit to provide in-depth courses to criminal justice practitioners aimed at filling critical knowledge gaps necessary for successfully countering terrorism and transnational crime.

COUNTER-TERRORISM ACADEMIC CURRICULUM (CTAC)

The IIJ Academic Unit has developed an innovative and ground-breaking Counter-Terrorism Academic Curriculum (CTAC). The CTAC is an in-person course designed for investigators, prosecutors and examining judges to increase their awareness of terrorism-specific issues as well as the knowledge and skills for successfully investigating and prosecuting terrorism-related cases.

This in-person, two-week course focuses on participant-based learning which directly involves the participant in the learning process and includes a simulated investigation and prosecution, as well as relevant, interspersed lectures or discussions to build the following core skills:

• How to effectively move from confession-led to intelligence-led investigations
• Improved drafting and advocacy skills to present evidence and legal arguments
• Understanding the significance of protecting human rights to deliver successful prosecutions in their own jurisdictions

The CTAC is offered to mid-level practitioners across Africa and the Middle East in English, French, and Arabic—with its second French-language course offered for practitioners from North and West Africa from 1 – 11 November 2022 in Valletta, Malta.

CONSULTANCY POSITION

The Consultant is expected to facilitate and exercise and deliver modules/sessions on Counter-Terrorism Trials for mid-level practitioners (investigators, prosecutors and examining judges) based on the Preparation to Fair Trial module already developed for and by the Academic Unit. This delivery is expected to be completed in-person in Valletta, Malta from 10 – 11 November 2022.

The consultant and the Resident Fellows will rely on simulated cases for the exercise, which will review the essential points necessary for the proper organisation and conduct of counter-terrorism hearings and trials. The sessions and exercises the Consultant will lead should emphasise topics including but not limited to: security measures of judicial actors, victims and witnesses, and suspects; evidence management; and coordination between judicial actors.

The consultant will adapt, moderate and evaluate these exercises according to criteria pre-established by the Academic Unit, in order to strengthen practitioners’ knowledge and skills required to deal with trials of terrorist or other complex criminal cases in a well-coordinated manner among all actors involved.

By the end of the module, participants should better understand how to prepare and conduct fair hearings and trials of terrorist suspects in their own jurisdiction.

The Consultant services will entail the following tasks:

Delivery of the module and reporting (5 days maximum)

• The Consultant is required to read and, if relevant, revise the relevant modules, to review and revise some exercises already prepared from the CTAC workbook and prepare for their delivery. The Consultant will specifically be tasked with supporting the delivery of the Preparation to Fair Trial module, as well as the course’s final exercise. To do so, the Consultant will prepare some presentations on the CT trial based on the CTAC module and his practical experience.
• Provide feedback on (and grade) participants’ assignments and lead the debriefing of the exercise.
• Facilitate exchanges and discussions with participants.

For all of the materials above, the Consultant must submit a post-training report, using the IIJ’s template. The report may be submitted in either English or French.

TIMEFRAME FOR PRODUCT DELIVERY

• The delivery of the module will be from 10 – 11 November 2022 in Malta.

• The post-training report must be submitted in its final version by 30 November 2022.

CONSULTANT CRITERIA & QUALIFICATIONS

• At least 20 years of experience in criminal justice as a judge or examining judge in terrorism or other complex, transnational crime cases.

• Experience in the delivery of courses on criminal justice, whether that be developing a whole programme of work or shaping existing programmes – preferably terrorism-related but may include other complex, transnational crimes.

• Experience of working internationally with other law enforcement/security organisations. Experience in Africa is an advantage.

• Experience of delivering capacity-building projects overseas as well as familiarity with the region and previous interactions with the target countries of the IIJ.

• Advanced degree in International/European Law, Law, Political Sciences, International Relations, Public Affairs/Public Administration, Development Studies or any related field.

• Professional fluency in French is required.

• Excellent drafting skills.

• Strong communication skills.

• Strong conceptual thinking and analytical skills

• Successful proven organisational and prioritisation skills.

• Energetic and adaptable in her/his approach with the ability to work individually and/or as part of a team.
  
  
• The ability to exercise good judgement and discretion at all times.

• Efficient in observing deadlines and achieving results in accordance with qualitative and quantitative parameters.
